Terms of Service

1. Acceptance of Terms

By accessing and using 1Fax ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Service Description

1Fax provides online fax transmission services allowing users to send fax documents to US and Canadian fax numbers. The Service includes:

  • Automatic retry attempts (up to 10 retries)
  • Delivery status notifications via email
  • Support for PDF, DOCX, PNG, and JPG file formats

3. Geographic Limitations

Currently, 1Fax only supports sending faxes to US and Canadian fax numbers. International fax transmission to other countries is not available at this time.

4. User Responsibilities

You agree to:

  • Provide accurate email addresses for delivery confirmations
  • Upload only documents you have the legal right to transmit
  • Not use the Service for spam, harassment, or illegal activities
  • Not transmit malicious files or content that violates applicable laws
  • Comply with all applicable laws and regulations regarding fax transmission
  • Not exceed reasonable usage limits (5 faxes per hour per email address)

5. Prohibited Content

You may not use 1Fax to transmit:

  • Illegal, fraudulent, or deceptive content
  • Unsolicited commercial communications (spam)
  • Content that violates intellectual property rights
  • Malware, viruses, or harmful code
  • Content that violates privacy rights of others

6. Service Availability and Retries

We make reasonable efforts to deliver your fax. The Service will automatically retry failed transmissions up to 10 times. However, we do not guarantee 100% delivery success due to factors beyond our control, including but not limited to:

  • Recipient fax machine being offline or busy
  • Invalid or disconnected recipient fax numbers
  • Recipient fax machine rejecting incoming faxes
  • Network or telecommunications failures

7. Data Retention and Privacy

Uploaded documents are encrypted and automatically deleted within 30 minutes after delivery or failure. See our Privacy Policy for complete details on how we handle your data.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1FAX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Unauthorized access to or alteration of your transmissions or data
  • Failed fax deliveries
  • Any other matter relating to the Service

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the past 12 months.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Account Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe:

  • Violates these Terms of Service
  • Is harmful to other users, us, or third parties
  • Violates applicable laws or regulations

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.
