1Fax Inc. ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our online fax service at 1fax.com ("Service").

2. Information We Collect

2.1 Information You Provide

  • Email Address: Required for sending delivery confirmations and tracking your free page quota
  • Sender Name (Optional): Company or personal name for the fax cover page
  • Recipient Fax Number: The destination fax number
  • Recipient Name (Optional): Name of the fax recipient
  • Cover Page Message (Optional): Any message you include on the cover page
  • Document Files: Files you upload to send via fax (PDF, DOCX, PNG, JPG)

2.2 Payment Information

Payment information is processed securely through Stripe. We do not store your complete credit card information on our servers. Stripe may collect billing address, card number, expiration date, and CVV code.

2.3 Automatically Collected Information

  • Usage Data: Fax transmission status, timestamps, retry attempts, and delivery logs
  • Device Information: Browser type, operating system, IP address
  • Log Data: Access times, pages viewed, and actions taken on our Service

3. How We Use Your Information

We use the collected information to:

  • Provide the Service: Transmit your fax to the specified recipient
  • Send Notifications: Email delivery confirmations and status updates
  • Track Free Quota: Monitor your free page usage per email address
  • Process Payments: Handle billing for additional pages
  • Improve Service: Analyze usage patterns to enhance functionality
  • Prevent Abuse: Detect and prevent spam, fraud, or unauthorized use
  • Comply with Legal Obligations: Respond to legal requests and prevent illegal activity

4. Data Storage and Security

4.1 Encryption

All data transmission occurs over encrypted HTTPS connections. Uploaded documents are stored in encrypted, private Supabase storage buckets with restricted access.

4.2 Document Retention

Automatic Deletion: Uploaded fax documents are automatically deleted within 30 minutes after delivery or final failure. We do not retain the content of your fax documents beyond this period.

4.3 Metadata Retention

We retain fax metadata (email, recipient number, timestamps, delivery status) for up to 30 days for customer support and service improvement purposes. This metadata does not include the actual document content.

4.4 Fax Transmission Security

Faxes are transmitted using T.38 FoIP (Fax over IP) protocol through Telnyx, which provides encrypted, HIPAA-compliant transmission.

5. Information Sharing and Disclosure

5.1 Legal Requirements

We may disclose your information if required by law, subpoena, court order, or government regulation, or if we believe disclosure is necessary to:

  • Comply with legal obligations
  • Protect our rights, property, or safety
  • Prevent fraud or abuse
  • Protect the safety of our users or the public

5.2 Business Transfers

If 1Fax is involved in a merger, acquisition, or sale of assets, your information may be transferred. We will provide notice before your information becomes subject to a different privacy policy.

5.3 What We Don't Share

We do NOT sell, rent, or trade your personal information to third parties for their marketing purposes.

6. Cookies and Tracking Technologies

We do not use cookies or tracking technologies on our Service. Your session and preferences are maintained without the use of cookies.

7. Your Privacy Rights

7.1 Access and Correction

You have the right to access and correct your personal information. Contact us at admin@1fax.com to request access to your data.

7.2 Data Deletion

You may request deletion of your personal information by contacting us. Note that fax documents are automatically deleted within 30 minutes, and metadata is deleted within 30 days.

7.3 Marketing Communications

We only send transactional emails (delivery confirmations and status updates). We do not send marketing emails. If you receive unwanted communications, contact us at admin@1fax.com.

7.4 California Privacy Rights

California residents have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to delete personal information, and the right to opt-out of the sale of personal information (note: we do not sell personal information).

If you are located in the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR), including:

8. Children's Privacy

Our Service is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us, and we will delete such information.

9. HIPAA Compliance

While our fax transmission uses HIPAA-compliant T.38 FoIP protocol through Telnyx, 1Fax is not a HIPAA-covered entity. If you are a covered entity under HIPAA and wish to use our Service for protected health information (PHI), please contact us to discuss a Business Associate Agreement (BAA).

10. International Data Transfers

Your information may be transferred to and processed in the United States or other countries where our service providers operate. By using our Service, you consent to the transfer of your information to countries outside your country of residence, which may have different data protection laws.

We may update this Privacy Policy from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this policy. We encourage you to review this Privacy Policy periodically for any changes.
